The court of appeal has thrown out case filed by NASA in the supreme court that public participation was not involved in procurement of alqurahi tender awardation.
NASA had also linked Uhuru Kenyatta to the Dubai based firm but court of appeal charges dismissed the claims.
In their rulling the charges claimed that the high Court discharged their discretion wrongly without considering the rights of millions of Kenyans to election in time.
They dismissed the decision by the high court that public participation is necessary.
Direct procurement is necessary and constitutional so long as its transparent, accountable and threshold is met.
