QUITE LONG
FIRST I wish to congratulate Hon Raila Odinga, his deputy Kalonzo Musyoka and the entire Nasa fraternity for a good court fight. It’s good that you decided to go to Supreme Court to present your petition. And though we all have our opinion about the verdict, we must accept that you had genuine grievances that you shouldn’t have ignored.
Celebrations are therefore in order and well deserved. Don’t fear to do it. Believe me you have robbed the celebration from our hands, we in Jubilee. We would have held the mother of parties for two weeks running up to swearing in. We were set for it and we were not hiding about it. But God has other plans for everyone.
I have received dozens of calls, texts and messages, some inquiring on the way forward and others just ridiculing me for believing so strongly that there was no case. I take it and accept it all and I invite you to rub it in. The way many Nasa brigades have been referring to me, makes me almost feel like I was one of the respondent in the case haha…I was not. I’m not Uhuru Kenyatta. I'm just a fellow followers and analyst like all of you who believes in himself. But the fact that you only thought about WT after hearing of the ruling, tells me that you always take my opinion with a pinch of salt whether that opinion is right or wrong. So yes, thank you for being my keen followers and once more, congrats and celebrate.
Last night, someone posted the accurate outcome of the case on social media even stating which 2 judges would dismiss and which 4 would allow the petition.
And when I saw the Nasa principal trooping to the court, I sensed that they knew something I didn’t. Case losers dont go to court on judgement day. But that is neither here nor there. If the judgment was leaked, so be it. We don't dwell on the past, yaliyo ndwele sipite.
I however expect Musalia Mudavadi to take issue with the reading of a judgment for 10 minutes. I thought he was only going to accept a full judgment from each judge which would have been 8 hours in the least.
WHAT NEXT.
The first thing in our minds now is when (which date) will the next election be held? I have heard its Nov 1. I don’t know where that information came from. Under Article 140(3) of the constitution a fresh election should be held within 60 days from today. That means any time before October 31st.
First, you should now understand that the coming election is NOT a runoff or a rerun as you call it. It’s a brand new election. As things stand now, there was no valid presidential election held on 8/8. It was all a nullity. But that is not 100% the case because the petition that has just ended, determines in several ways how the fresh election should be held, starting with the fact that it must be within 60 days.
My feeling as a Kenyan is that I don’t need to wait up to 60 days. Calling the fresh election within 30 days would be good enough. If the IEBC is ready today, I was ready yesterday. We should go to the polls by October 1st.
WHO WILL BE IN THE BALLOT?
In 2013, the Supreme Court gave an opinion on who should take part in the fresh election should the first one be nullified in a petition. The opinion (which stands as the position of the law) was that if the petition that invalidates the election was filed by only one of the candidates, the fresh election will only be between the petitioner and the president elect.
In this case, the petition was filed by Raila Odinga and Kalonzo Musyoka only and so the new poll will be between RailaLonzo and Uhuruto. Aukot and Wainaina only showed up as interested parties and not co-petitioners so they should be out. In fact, any candidate who did not file a petition is assumed to have conceded and that must include the two. There is no fence-sitting. With only two Presidential candidates on the ballot, one of them must certainly hit 50+1
WHAT TO EXPECT
I expect the next phase of campaigns to be real fireworks. The MPs, Senators and Governors and MCAs have now taken their seats and settled down. All their energy will be directed to the Presidential contest. This is going to be the real fight. I don’t know if the key luminaries who lost on 8/8 will influence the outcome in any way.
Which brings me to my long held opinion, that Presidential elections should be separated from the other elections. See how far back this particular election has taken us. But that is for another day and for others to determine.
I then expect all of us to come out and vote once more. Even in bigger numbers than 8/8. Those who trooped to the villages in buses to vote should prepare for another road trip. We are in for another fresh contest and this one is pretty serious. Githeriman should get more polythene paper (ops they have been banned).
I EXPECT the IEBC to be up to the game this time. Yes, it’s still Chebukati and group to organize and preside the elections within 2 months. Anyone saying otherwise can only be detecting defeat. This time the queues will move six times faster than 8/8 with only one ballot, one box and only two faces to pick from. This should be more efficient, accurate, verifiable and good.

THIS is the race that will tell us who between Raila Odinga and Uhuru Kenyatta calls the shots, without the influence of other candidates. No need for opinion polls, we know where we will vote when. The votes will be properly counted, tallied, recorded and transmitted. Within 6 hours we will have the picture of who will or will never (again) be president.
CAN THE outcome of the fresh election be challenged in another petition? Certainly. Even the next and the next can be nullified till we do it like angels. But after this one I expect losers to concede and go home. Until that time, Uhuru Kenyatta remains the PORK and Ruto his deputy. The two are however aware it’s now or never.
DOES today’s judgment affect the other elections? My answer is this. The others have 28 days within which to file their petitions, from the date results were declared. There is still time for that. If anyone feels that today’s determination can help him or her to dislodge a senator, governor or MP or MCA who won on 8/8, please use it and file your case.
