CJ Maraga ruled that the petitioner (Raila Odinga) failed to demonstrate how his votes were stolen and added to Uhuru Kenyatta's basket but in the wisdom of the four judges nullification of the will of the Kenyan voters was the best option.
Since transmission was the problem a reasonable judge would have ordered for the recount of votes but not a fresh election.
